Is Alec Baldwin Going To Jail?: Two counts of involuntary manslaughter will be filed against Alec Baldwin in New Mexico for the shooting death of cinematographer Halyna Hutchins on the set of the film “Rust.” Baldwin says he had nothing to do with the sad death.

We don’t know anything about what the prosecutor is looking into. If the news reports are true, there didn’t seem to be enough evidence at first to prove beyond a reasonable doubt that Baldwin had done something wrong. But Baldwin had to go talk to the police and the media after that. Now, the odds are at least even that he will spend time on probation or even in New Mexico’s version of Club Fed.

Baldwin was practising a scene for the western “Rust” in Santa Fe, New Mexico, in 2021. During practice, Baldwin pulled out his gun and pointed it at the camera between Hutchins’ legs. People nearby heard a loud “pop,” and then Hutchins fell backwards with a stomach wound that killed him. Instead of blanks, the gun had real rounds in it. The bullet also came close to hitting director Joel Souza in the shoulder.

Mary Cartmack-Altwies, the New Mexico First Judicial District Attorney, said that Baldwin and set armorer Hannah Gutierrez-Reed will be charged with involuntary manslaughter after a police interview with Baldwin.

Luke Nikas, a lawyer for Baldwin, said that the decision “distorts the tragic death of Halyna Hutchins and is a terrible miscarriage of justice.” He plans to fight the charge, but it won’t be any easier now that assistant director David Halls, who Baldwin says gave him the gun and told him it was “cold,” will help the prosecution after pleading guilty to negligent use of a deadly weapon.

What Is Involuntary Manslaughter?

In New Mexico, involuntary manslaughter is defined as the “unlawful killing of a person without malice” while doing an illegal act that is not a felony or a legal act carelessly.

So, under the law, the state has to be able to prove beyond a reasonable doubt that Baldwin was careless for Baldwin to be found guilty. Involuntary manslaughter is a fourth-degree felony that can lead to up to 18 months in prison and a $5,000 fine. If a gun is involved, you have to spend at least five years in prison.

From what we heard in the news, we didn’t think, at least at first, that the state could prove charges of involuntary manslaughter. Baldwin works in theater. His job on the movie set is to act, not to manage and take care of the guns. An armorer is paid by the studio to do this. The actor is not the one who loads the gun. Also, Baldwin says that the assistant director told him it was a “cold gun,” which means it wasn’t loaded. Even with a prop gun, an actor should be able to count on the studio’s experts when using a movie prop.

We thought that the prosecutor would have to do a lot of work to win. Baldwin then decided to talk about the case, first privately with the police and then publicly with ABC News’ George Stephanopoulos (part one and part two). We now have a different point of view.

Baldwin Should has Never Spoken A Word.

We’ve told you before that you shouldn’t talk to police without a lawyer there. “Everything you say can and will be used against you in a court of law,” you’ve heard on many TV shows with many letters in their names. People don’t seem to notice that the other side isn’t true. If you tell the police something that helps you, the court will throw it out because it is hearsay, which is not allowed. So there’s not much point in talking to the police.
