Texas Death Row Execution Melissa: Two days after the fatal injection, the Texas Court of Criminal Appeals on Monday approved a stay of execution for Melissa Lucio, a Latina accused of killing her two-year-old daughter. The lawyers of the inmate on death row announced the Court’s decision via a statement. Now, the case will return to the 138th Judicial District Court in Cameron County (Texas) to consider new evidence.
Wednesday, April 27. That was the date on which Latina Melissa Lucio was to be executed for allegedly killing her 2-year-old daughter Mariah in 2007 in Harlingen, a city located in the extreme south of Texas.
However, just under 48 hours after receiving the fatal injection, Lucio learned that the state Court of Criminal Appeals decided to stay the execution.
Thus, the judicial body responded to the requests of the defense, which requested the same suspension in the previous days to provide new evidence that would exonerate his client from having committed the murder of his daughter.
After knowing the decision of the Justice, the association ‘Death Penalty Action’ published through Twitter an audio document that collects the moment in which Lucio’s lawyer informs him of the suspension of his execution.
Now the case will go to a lower court, specifically the 138th Judicial District Court in Cameron County, which will have to review the allegations made by Melissa Lucio’s lawyers and review the course of the case.
The new evidence they want to present would show that little Mariah’s injuries, including a blow to the head, were caused after a fall down a steep staircase and that her mother did not end her life premeditatedly, which is the thesis that the authorities have defended until now after an interrogation full of unknowns.
